Data Use Agreement

This Data Use Agreement describes how Nestler, operated by Differson LLC, may process, aggregate, and use data generated through your use of the platform. It complements the Terms of Use. By creating an account and using the service, you agree to both documents.

How We Use Your Data

Product improvement: Understanding how users interact with the platform to improve features, fix issues, and design better experiences.
Platform operations: Enabling the Nestler Points economy, operator review, moderation, and platform analytics.
Research and analytics: Analyzing aggregated behavioral patterns to generate insights about rest, presence, and human behavior at scale.
Commercial data provision: Providing aggregated, de-identified datasets to third-party partners including wellness brands, mental health AI companies, academic institutions, and public agencies — under the safeguards described below.

What "de-identified and aggregated" means: Before any data is shared commercially, it is combined across multiple users and processed to remove direct identifiers (name, email, handle, IP address). Individual users should not be reasonably identifiable in any shared dataset.

Safeguards on Shared Data

All recipients of commercially shared or research-shared datasets are contractually required to:

Use the data only for the stated purpose (research, analytics, or the agreed commercial use).
Not attempt to re-identify individual users from the dataset.
Implement appropriate technical and organizational security measures.
Not transfer the dataset to additional third parties without written consent from Differson LLC.

Data Retention

We retain all user data — including data from deleted accounts — for a minimum of five (5) years from the date of account deletion. This retention period exists for legal compliance, fraud prevention, and operational continuity reasons.

Deletion requests mark your account as inactive and inaccessible. Your data is preserved in our systems but is not used for any new personalized features or visible to other users during the retention period.

Your Rights

Access: Request a summary of data we hold about you.
Correction: Request correction of inaccurate profile data.
Opt-out of commercial sharing: Request exclusion from aggregated commercial datasets. Requests apply going forward and may not retroactively affect datasets already shared.
Deletion: Request account deletion (subject to the 5-year retention period above).
Portability: Request a copy of your personal data in a portable format.

Future Integrations

Planned integrations including smart device data (wearables, biometrics) will require additional, explicit consent at the time of integration. No biometric data is currently collected. This agreement will be updated when such integrations launch.

Future platform features, including third-party seller integrations and expanded Shop functionality, will be governed by updated terms announced at the time of launch. Nestler Points remain non-redeemable for cash at all times; see the Terms of Use for the full NP policy.
