Welcome to Nestler. By accessing or using this service you agree to these Terms of Use. Nestler is an experimental spatial wellness platform operated by Differson LLC. Please read these terms carefully before creating an account.
By creating an account or using Nestler, you confirm that you are at least 18 years old and agree to these Terms and our Data Use Agreement. If you do not agree, please do not use the service.
Nestler is a browser-based 3D metaverse that allows users to explore immersive spaces, log moods, submit ideas, interact with in-app systems, and accumulate Nestler Points (NP). It is currently in beta. Features, content, and policies may change.
We collect data generated by your interactions on the platform, including:
Collected data is used for: product improvement, content moderation, operator review, powering the Nestler Points economy, and supporting the platform's research and commercial data pipeline. All data used commercially is aggregated across users and de-identified before use. See our Data Use Agreement for full details.
Nestler is built around a central premise: that rest, presence, and simply existing have value. The platform is designed as a virtual welfare environment — a space where being present is rewarded, and where the default state is rest rather than productivity.
Nestler Points (NP) are virtual credits issued by Differson LLC for use exclusively within the Nestler platform. NP may be earned through platform activity or purchased directly using real currency via Stripe. NP can be applied toward in-platform features, Shop items (including physical merchandise), services, and Creator Lab generation.
Certain NP balances may be redeemed within the Nestler Shop for physical merchandise selected and fulfilled by Differson LLC. By redeeming NP for physical goods, you agree to the following:
Nestler is intended for users who are 18 years of age or older. By creating an account or making any purchase, you represent and warrant that you are at least 18 years old. Nestler does not knowingly collect personal information from individuals under 13. If we become aware that a user under 13 has registered, we will delete that information promptly. Parents or guardians who believe a child under 13 has an account should contact contact@differson.net immediately.
Applicable sales or use taxes on digital goods or physical merchandise may be collected at checkout depending on your jurisdiction. Tax calculation is handled via Stripe Tax. You are responsible for any import duties, customs fees, or local taxes applicable to physical goods shipped to your location.
You may request account deletion at any time via the dashboard. When deletion is requested, your account is marked with a deletedAt flag and becomes inaccessible. Your data is not immediately purged from our systems.
We retain deleted user records for up to five (5) years for legal compliance, fraud prevention, and accounting purposes. During this period, your account is treated as deleted for all practical purposes and is not visible to other users.
To support the platform's sustainability, Nestler may share aggregated, de-identified, non-personal datasets with third parties including academic researchers, public agencies, or commercial partners.
"Aggregated, de-identified, and non-personal" means behavioral patterns and usage statistics combined across many users, with all direct identifiers — including name, email, username, and IP address — stripped before sharing. No individually identifiable information is included. Shared datasets reflect collective trends, not individual users.
We will not sell data that directly identifies you (email, username, or any personal identifier) to third parties for commercial purposes without your explicit separate consent, except where required by law.
All recipients of aggregated data are contractually required to: use data only for stated purposes, not attempt re-identification, implement appropriate security measures, and not transfer data to additional parties without written consent from Differson LLC.
To opt out of aggregated data sharing, contact contact@differson.net. Opt-out requests will be applied going forward and may not retroactively affect previously shared datasets.
Where applicable under EU GDPR or California CCPA, you have the right to: access your data, request correction, obtain a portable copy, request deletion (subject to retention obligations), and object to certain processing. Contact contact@differson.net to exercise these rights.
Nestler may in the future permit third-party merchants to list physical or digital goods within the Shop, redeemable via NP. When third-party sellers are present, the relevant product listing will identify the seller. Differson LLC acts as a platform intermediary and is not responsible for the quality, accuracy, or fulfillment of third-party listings. Disputes regarding third-party goods should be directed to the seller; however, Differson LLC reserves the right to intervene at its discretion. Third-party seller participation is governed by a separate merchant agreement.
You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to reverse-engineer, scrape, or extract data from the platform; (c) impersonate another user or entity; (d) exploit bugs or vulnerabilities to gain NP or other advantages; (e) use automated scripts or bots to interact with the platform; (f) attempt to sell, trade, or transfer your account or NP balance to another person.
Nestler is provided "as is" and "as available" without warranties of any kind, express or implied. Differson LLC does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. The platform is currently in beta; features may change, be removed, or be unavailable at any time without notice. Your use of the platform is at your own risk.
To the maximum extent permitted by applicable law, Differson LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of NP, data, revenue, or goodwill — arising from your use of or inability to use the platform, even if advised of the possibility of such damages. In no event shall Differson LLC's total liability to you for any claim exceed the amount you paid to Differson LLC in the twelve (12) months preceding the claim.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.
We may update these Terms. Material changes will be communicated to users via email or in-app notice. Continued use of the service after changes constitutes acceptance of the updated Terms.
